We went to mediation and can not agree to a visitation schedule. My daughter is in Kindergarten now and her fahter lives an hour away. He currently has her on Wednesdays overnight and we changed it to every Friday night. I do not like this arrangement as it infringes on my quality time with her on the weekends. He and mediator called me via speaker phone when I called to cancel meeting because I had to pick up my daughter. They wanted to keep the Fridays as is I said I do not agree. I suggeasted to give up Wednesdays and have a Friday to Sunday and a dinner visit. Then mediator stated he does not agree even though it is reasonable. Is this grounds for an ex parte?? I do not want her to have a Wednesday overnight as it is not in her best interest to be woken up and taken to school an hour away!! not fair to a five year old and unsafe in rush hour traffic, when she could be home with me and be at school 10 minutes away!! Could our temporary order be used as an exparte?? It is revoked as of today and other order (Wednesdays ) are back in effect. I hope this was not confusing.

The sort of emergencies that are usually covered are spousal abuse child endangerment etc etc in this type of disagreement both sides need to be heard.
The sort of disagreement both sides need to be heard.
For emergencies not for disputes over visitation the sort of disagreement both sides need to be heard.
