So this girl walks up to my sister. Shes 8 years older, my age. My sister is only 9. So she walks up to her and pushes her down to the ground. She starts talking so much shiet about her and my family. I know this girl and she hates me to I never even talk to her. So these to girls come up on the side of her and start hitting her with a bat. They start hitting her and pucnhing her and kicking her. Then my boyfriend and I drive through that way because we usually pick up my sister at that spot. When we get there the girls start to run. My boyfriend puts her in the car and brings her to the hospital I stay and ask anyone if they saw what happened. I called my parents and they rush to the hospital. This one lady who lives in a house right in front of where she got beaten up. She tells me everything they did to her. This lady didn’t want to go out because they were going to hurt her so she called the cops like a little to late. So yeah my sister is severally hurt she has a broken leg and arm. a black eye and hurt lips are plump.My sister has asthma and they almost gave her an asthma atack Could we go to court? Can we sew them?

We went to mediation and can not agree to a visitation schedule. My daughter is in Kindergarten now and her fahter lives an hour away. He currently has her on Wednesdays overnight and we changed it to every Friday night. I do not like this arrangement as it infringes on my quality time with her on the weekends. He and mediator called me via speaker phone when I called to cancel meeting because I had to pick up my daughter. They wanted to keep the Fridays as is I said I do not agree. I suggeasted to give up Wednesdays and have a Friday to Sunday and a dinner visit. Then mediator stated he does not agree even though it is reasonable. Is this grounds for an ex parte?? I do not want her to have a Wednesday overnight as it is not in her best interest to be woken up and taken to school an hour away!! not fair to a five year old and unsafe in rush hour traffic, when she could be home with me and be at school 10 minutes away!! Could our temporary order be used as an exparte?? It is revoked as of today and other order (Wednesdays ) are back in effect. I hope this was not confusing.

This Friday is the bench trial for a Domestic Violence Restraining Order- this is the second one in four years that my adult daughter has filed. The first was dismissed for lack of merit. Her current allegations are way off the charts since I have had little to no contact since the first one. O.K.- to my question… are judges prudent when granting DVROs or do
they hand them out like candy on Halloween? I am pro per in California. Any experiences?
I thought I might add that it is and never was an issue of physical abuse. She is claiming that I intend to kidnap my grandson. Charming daughter, isn’t she? She and my grandson lived with me while she earned her college degree. I supported both of them. It was actually a great time. Perhaps she is resentful because her child bonded with me and not her. Not my fault- she was rarely there. Like I stated earlier, there has been very little contact- NONE of which has been face to face.
And I have NEVER even so much as implied an intent to abduct my grandson. Where would I take him? To my secret villa in Spain? The singular deed for which I DO accept accountability is sending a small family photo album to my grandson. This was after my father passed away. I did not want my grandson to forget his family- the family that he adored and the family that was taken from him on a malicious whim. FYI- In giving this photo album, there was NO physical or verbal contact with my grandson. He is now 12 years old.
